A late filing penalty was assessed on an E-filed New Mexico personal income tax return with balance due to be paid electronically on April 30, but the payment actually occurred on May 2 because that's date Lacerte software placed in the e-file spec that was sent to the NM Taxation & Revenue Dept.
Upon learning of these facts the department abated the penalty it had assessed on the specific return at issue. Then the department researched its database, found an additional 124 affected returns and abated those late-filing penalties on its own initiative. Kudos to the NM Tax & Rev Dept. for the considerate follow-up. And let's not forget Intuit, who agreed to pay the interest, which, by sttute, the department could not abate.
