Exempt or Not

United Kingdom citizen has a O1 visa and has worked in USA in 2007 for 3 month and made $9000 as an independent contracted choreographer in USA. The company that pays him is a USA company. Is he required to file a 1040NR and is he exempt from US tax by any treaty.

Truck expenses

I think the nature of the responses strayed from your original question, so I hope this helps. I've had success in audits by coming up with an actual cost per mile based on documentation from later years.

It should be easy to come up with mileage from the log books. I would hope that he would also have some receipts for repairs, tires, scales, insurance, etc.

I would then go to 2006 or 2007 and figure out how many miles/gallon he uses. By using that number times the miles driven in 2005, you should be able to get the agent to agree on the gallons that were used in that year.

Finally, you need to determine the price of fuel. I don't know if that's available on the internet, but this is another possibility. Have your client talk to other drivers or to truck stop operators and see if they can provide any documents that shows the price of a gallon of fuel. Most independent truckers keep their fuel tickets, so it shouldn't be hard to talk one or two of them to make copies of some of them. I like to use the first of the year and the end of the year and take an average. Give the truckers a self-addressed stamped envelope with $20 in it for the trouble & it should work.

When you are armed with all that information, you have a fighting chance if you get an experienced auditor.
