Hello, and welcome to TaxAlmanac! My name is Tim Doyle and I serve here in the role of TaxAlmanac Moderator. If you haven't done so already, you might want to review our Quick Start Guide to help you get oriented.

Your Discussion Question

Chris:

I found the question that you asked and moved it to the discussion forum. Sometimes people ask questions in other areas on the site, and I am trying to understand how and why this happens. It's nothing you did wrong, but perhaps there's something that I can do to TaxAlmanac to make it easier for people to use. Could you explain where you were and what you did to ask the question? Anything you can remember would help.

Missing Post

Chris:

I found the question you asked. It appears that you added it not in the normal way, and so it was added as a page in the main area and not in the discussion forums. Can you explain the steps you went through to add it? That will help me to understand and hopefully to make corrections so it's easier in the future.

Hi Chris:

I'll go ahead and move your question right after this, but I wanted to let you know what happened.

The Start new article link where you went is where you would go to submit information to add an article to TaxAlmanac's library - an overview of credits, etc. It's where you can write a little bit about what you know in order to give back to the community. Items added here do not show up in the forums as they are not intended to be questions / discussions.

Because some people do get confused by this, I have a link in the left-hand column which takes you to the forums. Apparently even that isn't grabbing people's attention.

If you want to ask a question, you need to go to the Discussion Forums, pick the forum you want, and use the link at the top to ask your question.

I'll go ahead and reformat your question to fit the forum and move it there.

Your 5405 question

Chris - you posted your question as an article, but I'm not going to go through the process to move it to discussions, as you'll just be told to be a little more patient. Proseries - and all of the software providers - need some time, generally a week or two, to get the forms into the software once they're issued by the IRS. The 5405 was issued on 2/21/09, so I wouldn't expect it in PS anytime this week. but you never know!

2% tax

If the tax withheld was income tax, yes it would be deductible on Sch A, but he would file a NJ return to get it back for 2009 since he had no taxable income from the sale. You wrote 'Transfer tax' which is a different kettle of fish since I believe there is a 1% transfer tax, but am not sure. That tax is not deductible except as a selling cost. Most of my practice has been in PA, not NJ.
