The American Jobs Creation Act of 2004 clarified the rules about computing depreciation for vehicles that qualify under this section. According to their Headliner dated March 18th, 2005, the truck, van or SUV still does not need to be new, rather only placed in service. A vehicle with an unloaded gross vehicle weight (GVWR) of more than 6,000 pounds is exempt from the limitations.
