With all due respect, I can't make heads or tails out of this information. You start by talking about a 1040 issue and then you head into a payroll tax problem so I assume it's a 941 issue, but I'm really not certain. It sounds more complex than we can handle in this forum, but I'd be more than happy to discuss this by phone. Please contact me via email at skasselea@etaxes.com
IL tax on MI company
Well, Wayne, is this being recorded? :) I'd first determine that there IS no nexus...
Unless they're delivering the goods on company trucks to IL, there shouldn't be a nexus issue. And so, no obligation to collect IL or MI taxes. If they do deliver on company trucks, I think I'd just start filing, register and move forward. Since they've not charged the tax to the customers, it was on the customers to file the use tax. Yeah, right, me neither. Well, I did have ONE guy pay use tax. Still don't know why, but he insisted. So have them start collecting and paying over the taxes eff. 9/1. You can register on line now...www.revenue.state.il.us and the link's in the upper left as I recall. Jeff JR1
