Accounting Students Using this board

As you can tell, I've been a poster on this board for the last few weeks. I learned about it from a Quickbooks seminar on the 2007 Quickbooks Accountants Edition. I really enjoy participating in the board, and in responding to questions. However, I do resent accounting students coming here asking us to do their homework assignments, work out their specific tax problems because they want to avoid having to pay an accountant under the notion that they know something about accounting/taxes. You've got one on there now - a freshman accounting student with a husband who is a medical malpractice attorney - who just wants us to give her answers, because with her limited knowledge believes she's going to do everything on her own to avoid consulting with someone who does know. She apparently isn't familiar with payroll tax issues, tax ramifications, compliance filing - but expects that with her limited basic elementary knowledge - is going to come here for answers. If she's not stopped, she'll probably come back here again. How are you able to stop this practice?

I too do not think we should be answering students' questions for them, with the possible exception of some theoretical questions that might involve several arguments. See my reply to Uncle Sam.

Why is there a blue dashed line around the body?

 I'm new to Tax Almanac.  I've sent this message to two people, and I don't understand why there is a blue box around the body of this message.  Am I doing something wrong????

Good morning,

I just want some clarification on the 351 transfer of assets & notes payable from a Sch. C to an S-Corp.  Situation is this:  Trucks & equipment NBV are around 200,000, loans are around 100,000.  Some of the trucks are fully depreciated, but still carry notes.  (Don't ask how/why-previous tax preparer deducted mileage AND actual expenses!!!.)
I believe I transfer the assets at lesser of FMV or book, & transfer the notes at principal balance.  But do I do it in total?  That is, on the eqpt that's fully depreciated, the taxpayer is transferring zero basis, and being relieved of a liability.  Is this "gain" taxable?  When I read Sec. 357(c)(3), concerning liabilites assumed, I am a bit confused.  When I transfer these notes, they do not create/increase an asset.  Give rise to interest expense only. Therefore we leave the N/P's out of the equation?????  I'm confused.
 Also, an unrelated question.  If the Sch. C "rented" the equipment/trucks to another C-Corp, would this be SE Taxable?  It appears to me this is the rental of personal property.............

Sorry for the delay in getting back to you with any ideas. You had talked about the limitations regarding namespaces, categories, etc. and it gave me an idea that I hope could work and be considered for implementation.

As I write this, I notice that "All Topics" is composed of 6,261 posts of which 5,941 are from the Tax Questions Forum. Since so few questions / comments (only 320 as of now) are in the other "Discussion:" namespaces **combined**, can we do the following:

1) Change the namespace of the current Tax Question Forum and code it as available to everyone. That is, paid preparers who have completed a profile, self-preparers and anyone who has not completed a profile stating that they are a paid preparer. Making the "historic" forum available to all does not disadvantage anyone retroactively. And, as time goes on, only OPs from self-preparers will be posted here.

2) Add a second Tax Question Forum called Tax Questions From Paid Preparers (or similar) and give it the same namespace as above. This one would be coded as only available to those who have filled out a profile and checked a box stating that they are a paid preparer. (Pseudonyms could still be used for those who wish to remain anonymous.)

3) Create the mashup that allows the two forums to be viewed at once a la "All Topics" in the "Discussion:" namespace.

Those who have created their profile and checked the paid preparer box (or perhaps one of the following boxes: CPA, EA, Attorney, Paid Preparer, etc.) could bookmark in one of three ways: a) Forum with OPs from self preparers; b) forum with OPs from paid preparers with profiles; or c) the combination of the two forums.

Side-Effect of Switch From Beta

Tim:

When TA was still in beta, "my talk", "preferences", etc. were in the upper right-hand corner of my screen. After the switch they are in the upper left-hand corner. The problem is that the TA logo, which has not switched places, covers up "My Talk" and probably one other choice that I cannot remember. The only choices I see now are "preferences", "my bookmarks", "my contributions" and "log out".

Similarly, ". . .this IP" and "Create an account or log in " used to be in the upper right-hand corner, but have switched to the upper left-hand corner. The ". . ." above is what is hidden by the TA logo.

Beta Side Effect

Tim:

I actually use Avant Browser; however, I competely forgot that it is an "overlay" of IE. (So much so that when you click Help / About it only gives the Avant Browser Build Number rather than including the IE version as well.)

At home I, in fact, did upgrade to IE7 while at work we still use IE6. And lo and behold here at work everything is in the correct place.

I *love* coincidences. And I *love* Microsoft.

Ironically, I just received my latest e-mail from Steve Ballmer regarding how great Microsft is and how it will make me taller, more handsome and richer. All I have to do in exchange is drink the Kool-Aid.

I am having trouble. I made a post, not to cause a problem. I am not a CPA. I am looking for the law that requires me to file a tax return and pay taxes. I have heard some information that disturbes me.

Hey there Tim. I have to say one thing; I am disappointed in some of the members here and even though I know you can't do much about it, I just needed to vent.

There are some almightier than others here who post answers in very harsh and insensitive words. I watch the forum sometimes and don't post at all for this very reason. Some of the new members tend to think they know "EVERYTHING" and then talk down to those who don't know as much.

This is only recently that I have seen this and I hope and pray that new posters here will not be reluctant to ask questions for fear of humiliation on this board.

I love tax almanac but as it is with anything else on the internet, you can take what you need and leave the rest but is there a way we can all approach each other with respect and not post things which are negative on the person and or their expertise?

I also think that Intuit doesn't need to bear the weight of policing this site and I understand completely.

I blanked out your phone number and email address that you added to this page. It is common for automated "robots" used by spammers to view any and all webpages they can find to add phone numbers and email addresses to their collection for spamming purposes. I'd hate for you to start getting spam due to your posts on TaxAlmanac.

Yvette left you a message here, but to reply to her, you'd need to go to her talk page. Only then will she be notified that you have responded.

Also, a better way to begin private communication is to go to her page and select "E-mail this user". That's the safest way to send someone your phone number or email address without announcing it to the world. In order for this to work, the other person must have added their email address to their preferences. If they haven't, they can go to your user page and send you a message in the same way. If you need any help with this, just let me know.

Mendatory Profile

Hi Tim, First of all let me thank you for doing such a wonderfull job maintaning "Taxalmanac."

Two suggestions: 1) Make profile mendatory to use this site. Without a profile it is very difficult to know expertise of the user.

2) Add a column "Original Post Date." Sometimes users answer a question after six or more months later and it goes on the top of the list. If it is very old issue I do not like to read it again (unless it interest to me).

I'm enjoying TA

I'm enjoying using TA. The interface is comfortable to use; and, I'm beginning to use the resources. I would like a more specific search tool. For instance, when I just want to see a specific IRS document, say a Code section,0 I would like be able to go there without encountering the rather broad results that are presented. I also find browsing resources such as the IRC tedious. I also wish there were more members who were more forthcoming about their profiles. The scarce personal (really professional) info. makes be question credibility and even motives at times. I find it off-putting when someone remains anonymous or who seems to represent themselves as expert and posts authoritative-sounding material. Real names would be nice. So I'm trying to be somewhat careful in who I respond to as well as the topics; and, in the quality of my postings. That means doing some hard research which is time-consuming. I knew about linking to Publications, but sometimes, it's quicker for me to copy and paste the URL where I looked up something, usually at the IRS site from a bookmark on my home page (out of habit). I'll try to remember to link to Pubs here from now on, unless the link goes to a certain section within the Pub. Hi again,

For an example, after you edited the Pub URL that I posted a few minutes ago, users now have to click three times to get to the link that I posted (that would have taken one click, if the link had remained unedited). Since your edited link finally gets to the IRS site after three clicks, is it incorrect for me to continue posting links that go directly to the IRS site and which go to the exact spot in the Pub that I intended? I just want to make sure that I'm not breaking any rules here, but I also try to do things the quickest way.

Ok, yes, I do understand why you prefer TA links. I didn't think about the fact that the IRS may change their links in the future.

As far as the three clicks: (1) clicking on the link in my msg, (2) then clicking on either HTML or PDF on the TA Pub page, and (3) then clicking on the section title at the IRS (HTML version) to get to the section I was researching. My link went directly to the section in the Pub at the IRS.

From now on, I'll link only to TA and then will add further instructions in my messages telling people where to find the information in the Pub.

Like the majority of other users, I'm only interested in the discussions here. Most tax preparers aren't writers, so I can understand why articles are not being written on TA. I understand what you're trying to do, but I think the discussions are the most helpful to tax preparers and individuals.

Thanks again, and I do appreciate all that you've done with this site. I know how time-consuming it is for you, because I used to have two large web sites, and I literally spent most of my waking hours maintaining the sites and editing pages.

New Idea

Sounds like a great idea, and I had a feeling your idea was about something like this. I think it would really help to have categories set up, and I wouldn't mind at all helping out with this. I also agree with you about messages floating to the top after minor edits, and I've wished there was a way to get around this. So, when do I start? I have the Bad Debt message edited, but I haven't saved the page yet, because I assume something needs to be done first to set up the categories (the links are currently red when I previewed the edit).

Adding the topics is another great idea! When I went to my New Messages page, I thought I saw a message from you that said your idea was to add only two topics, but when the page actually loaded, that message was not at the end of my messages, so I don't know if I imagined seeing that or not. Please let me know if I'm adding too many categories. Yea, this is addicting, but I'm wondering if I should quit for awhile, since I'm starting to bring up messages older than 24 hours.

I think your ideas to add more to the Community Portal are great. After you've added the new descriptions, posting your changes to Tax Questions would help bring it to everyone's attention. Ok, I'll quit for now but will continue to add categories now and then. I think tonight was a good time to add a bunch, since I have a feeling there is less traffic on Sunday nights. Hi Tim,

Regarding Energy Credits vs Credits, there are about 20 credits available, such as, earned income credit, child care credit, energy credit, child tax credit, tuition credit, etc. But I'll leave it up to you. Just let me know if you prefer one category titled Credits. Also, thanks for letting me know about clicking on the red links and creating pages for them. I wasn't aware that I could do that and will do that now from the Category pages. Then I should get to work.

It just happened again

As I'm writing to you, it happpened! Suddenly, the sentence is gone. Not letter by letter. Just gone. And the screen reverts, like you're refreshing. Hmmmm. I changed a setting on my browser to automatically refresh, I bet that's it! Thanks.

Misc

I wondered what Deb was up to! She was refreshing so many things...and I didn't see her tracks. I use Avant, which is a skin over IE with multiple tabs like Firefox and Opera. I just discovered last Fri. that I could have it auto refresh every so often depending on what time frame I asked for. So what it was doing was refreshing, while I was writing...and making it go away! Have now ended the auto refresh thing, too bad, since it was handy. Ah well. Sorry for alarm.

Hi Tim,

I've gotten through the forms and publications you have listed here, but I still need to organize the Individual and Expenses categories. Some entries need to be added or deleted from those categories to be more logical, but I have to stop now and go get my pacemaker checked and then start on the year-end work (which will take the rest of the week). I'm pretty sure I'll have some time at night in the next few days to get back at this. I have a feeling I won't have much time to add categories to the discussions until after April 16th. I'm a little nervous about doing that too much, due to the "floating" problem and the confusion it causes. Thanks for allowing me to help out!

Hi Tim,

It sounds very good to me. I found nothing I thought should be changed in the wording. One thing I've been doing when creating pages for new categories is to just type "& n b s p ;" without the quotes and spaces, but I don't know if this is important to mention or not. I'm just starting on doing my work for today, but I'll probably be back on here later today. Thanks again.

Deleting Discussions

Thanks, Tim, for letting me know how to delete discussions. I'll check it all out later (sounds easy enough), but I wanted to let you know what happened, in case you weren't around then. The user posted the same question twice, and one of the messages had a subject title of RE only. I added a category to her other message that had the correct title, and then D&T answered her question in the bad RE message. So, I quickly pasted his message into the correct title message and then changed the title of the bad message to Please delete this, Tim, so that others would not respond to the bad message.

Deleting Bad Messages

I tried this on the current "1031 Excange" message that is blank. I deleted the top line, and the message did not disappear from the Tax Questions forum listing, so I'm not sure what I'm doing wrong.

Since then, the user typed his question into the message, so I can't delete it now, but I guess I need a little more help with this.

I think I know what happened. The user probably had that message open, typing his message (on his 2nd attempt), and that could be why the message didn't get deleted. Before I wrote to you the first time, I had added back everything that I deleted the first time. I'll get this eventually. :)

Articles and LLC

Hi Tim,

I did realize what you meant by articles the other day after we first discussed it, and then I realized it was something I could do. At some point, I realized that text from the IRS could be copied into articles here, so it's basically creating pages (using non-copyrighted material, links, actual writings, etc.) and organizing it all on a page (which I've done in the past many times--the web sites I used to have had about 5,000 pages. I spent a lot of my time from mid-1996 through 2000 in Editpad--but I was also winning substantial prizes from Geocities, which I sold on eBay and to a local computer store, so I had an incentive to continue working on those sites--until Yahoo bought out Geocities, and then I deleted the sites near the end of 2004, due to being bored with them).

At the time I created the LLC category, I didn't realize you already had a Limited Liability Company page. If I had taken the time to look around some more, I might have found that and would have included a link to that page. But I think your edits are perfect! It looks great. Thank you for letting me know what you're working on, which helps give me more ideas on how I can help some more.

I realize there's a lot more to be done here, but it would take a lot of time that I don't have right now. But I'm going to try to add more categories today to some of the current articles and other things, as I find them, etc. I have three more year-end accounts to work on, but they haven't been dropped off yet, so I should have some time today, once I find some energy.  :)

Actually, I just remembered I've had three tax clients drop off their documents, so I probably should get started on those. Don't know if you'll notice that I added this last paragraph.

Deleting Messages

I tried this a few minutes ago (deleted the top line in the discussion) and even tried again by deleting all three lines in the bad message, but the message didn't disappear. So I just left it the way it was originally. I guess I'm doing something wrong. I'm deleting the entire {{ForumThreadHeading|Tax_Questions|Tax Questions}} on the top line in the "Individual Pin Numbers in Pro" message that is blank.

By the way, just FYI, I also ran a popular BBS in mid-Michigan (with four phone lines, six computers, about 100 online games, about 1000 message bases, and about 60,000 shareware files) from 1990 to 1997. I still write batch files, use DOS quite often, and have built over a dozen computers. I also was a Beta tester for Intuit for a year or two, just after Intuit bought out the company's software I was using. I started with CPAid in 1990 and then I ended up with Intuit in about 1996 or 1997. Intuit has been by far the best tax software, but I really hope the problems mentioned in the above thread can be fixed soon.

Deleting Spam

Hi Tim - I'm sorry to keep bothering you with this problem, but I just deleted the top line in the "How would you like to pay ZERO Tax?" discussion. I refreshed the page a few times and even went to my home page and deleted my cache. (My MSIE browser settings are set to show me the most recent page.) The message is still listed in the Tax Questions forum. Just wanted to let you know about the problem I'm having and the recent spam message.

Thanks for letting me know a little history about yourself, too, and thanks for the interesting links. I noticed you have Adams in your family. My maiden name is Adams, and I'm related to the two presidents (Adams)--but on my mother's (Smith) side (they are distant cousins, a few times removed). She did family research for almost 50 years before she died, both the Adams and Smith sides, and also found that I'm a distant cousin to the two Roosevelt presidents and possibly to Brigham Young (but no exact proof). I wanted to help her, but she was stuck on all of the lines for years, and there wasn't much I could do to help her, so I went to the libraries with her and researched my ex's (Ackley) line for awhile and then forgot all about it after we divorced in 1982.

New Problems in the 2006 ProSeries Pro Software

Sorry for the delay in responding to this. I've been trying to decide what's important to report as problems in the program. I think I'll go ahead and just deal with entering the full birthdates, especially if there turns out to be no problem efiling incorrect birthdates for dependents when the year is correct. (If it would be too time-consuming to find out full birthdates from clients, I think I'll enter 07/01 but haven't quite decided yet.) The most time-consuming thing for me will be to check the "automatically enter PIN numbers" box. The discussion for this is here: Individual_Pin_Numbers_in_ProSeries_Professional Last year and prior years, that box was automatically checked for all clients, and I didn't need to check any boxes or enter PINs.


The additional questions that now need to be answered on the EIC worksheet will be pretty time-consuming for me. That discussion is here: EIC_-_Automatic_Due_Diligence_is_No_Longer_Automatic. In that same discussion, I also mentioned that I now need to enter my PIN on every state return for the city return--even when there is no city return to be filed. That step could be eliminated if the state module would get my PIN from the Federal module.

When I post, there is a box for 'Summary'. I have started filling it out but don't have a clue as to where it shows up. Yes, that would be a great idea! Then everyone would know about the discussion. I could also copy and paste the messages I recently wrote to JR in the new discussion area. (I've always wished there was a reply feature when answering personal messages, too, but don't know if that's possible with Wiki.) Good idea, Tim!

City Tax & PIN Problem

I thought I would be more specific about the PIN problem in the State/City program. In order to efile the Federal and State returns, I have to enter a five-digit PIN in the PIN field under "If third party designee is NOT preparer". This question relates to the city return, whether there is a city return included or not. I just verified this by opening up a client file with no city return. I still have to enter a PIN number in that field, even though I'm the preparer and third-party designee. This field is only for third-party designees who are not the preparer and only when a city return is included, so this is definitely a bug in the program.


If there is someone else at Intuit that I should either write to or fax bugs like this, I would be happy to do that, but I don't know where to send messages like this. There used to be a form within the program that I could type up problems and then send the messages to Intuit, but I don't think that's been available for a few years. I don't want to bother you with things like this, if I should be directing them elsewhere.

No, I guess I never paid attention to that link. Thanks for bringing it to my attention. I would have already added categories to tons of discussions, but I've been staying away from that most of the time, because I don't want those discussions moving to the top with my name listed. If this problem is ever fixed, I would probably spend a lot of time doing that (especially after April 15th). I might get back to the articles today or tonight and do the rest of those on the Business page (under General Info), starting with S Corporate. Then I'll need to go deeper into some of the main headings to find more articles to categorize. I've also noticed that some IRC pages can be edited and some can't. Same with the Regs, so I haven't done anything with those pages.

MSSPs

I started working on that for a minute, but then got distracted with more questions. It's not easy to do both, and right now, I keep thinking I should be resting, instead of sitting at the computer all the time. This is probably the last day I'll have no "real, income-producing" work to do until after April 16th. I like doing this stuff sometimes, but it is zapping the energy that I'll need for the next three months, and I have a feeling I'll regret not resting when I could and should have. I could spend hours on the MSSP and ATG pages, but I don't think my lower back can take much more of this. So, I'm not sure what I'll decide to do the rest of tonight.  :) Plus, I could tell you were working on it, after I started, so that's another reason why I decided to quit for awhile.

Corporate and Shareholder tax questions

Tim, I am studying this topic and taking a review test. I am a finance person and am taking my masters in Taxation. I cannot believe how incredibly difficult it is to research one question and I have 150 on my review exam. I have spent a lot of time and am down to about 15-20 questions I cannot find answers to. Is there anyone I can hire to tutor me with this? I am at my wits end, but dont want to drop out of this course. I have used the BNA website and googled and am using the Bitker and Eustice book. It just seems to take forever to answer one question and research it. Thanks very much for any suggestions or resources you can locate. I would definitely pay someone to help me. i am in favor of a split and it does not really matter how you do it. i look at this site from time to time but get discouraged when i see the utter simplicity of some of the questions posed. it is a waste of my time to sift thru this kind of stuff. it is apparent some persons are very new at tax prep and consulting or they are just too lazy to look something up in order to find the answer and retain the answer for the next time they need it.

i did not realize i guess that lay persons have access to this site. maybe that is why the questions appear elementary.

so i guess seperating the tax preparers and the public is a very good idea. that should enhance the quality of the information disseminated.

Proseries not in taskbar

I started to open Proseries today to check for an answer to a query on TA, then went to Outlook Expess while it opened, leaving TA on the taskbar. After a few seconds, Proseries flashed on the taskbar but disappeared and this while I was in Outlook Exress. I went to desktop and Proseries was open and at that point, it appeared on the taskbar. You asked if it happened when I was at another site. Not quite another site but another function.

How do you straight out leave a message for a user ?

It would be helpful to have at the top of the menu/tool bar an icon that states "leave msg to user". I'm having the hardest time finding how to send message/email to members of forum. Like for example, to find your signon, I had to recall a previous disccusion that contaned your userid with (talk to me). The small task seems so confusing. Also, is there a quick reference as to how to navigate this system? Thanks for any insight you made have.

What color is Stormy? Mine was buff. I used to have a cabin on a trout stream and whenever we went there the first thing he'd do when we let him out of the car was run down to the stream and go for a swim. We finally had to keep his fur cut short (he looked like a puppy) because he loved to run through mud and grass and get burrs all in his fur.

Medical Categories

D&T added the new category "Medical Expenses" recently. I noticed it last night, and since there were already a few links in the "Medical" category that I set up a month ago, I coded the "Medical Expenses" category to "Medical." I didn't want those old messages to come to the top and didn't have enough time to fix any of it, so I just did that quick edit. Yes, they can be combined and should be. The category should have been "Medical Expenses" but leaving it as "Medical" will result in fewer edits. It doesn't matter to me how you fix it.

Hello: I'm definitely open to a discussion about using TaxAlmanac. I work in an LLM program in a law school. The tax research class is required. It is part of a tax research and writing seminar, so we are almost finiahed with the research part. The class is only meeting three more times this semester before suspending to write, but-- if we don't have much time to incorporate the tax alamanac wiki, I can always do it with next year's class.

Do you have anything in particular in mind for how we might use it with the class, other than just alerting them to the fact that it is here?

I am working on a return where the taxpayer has sold a home to a non-relative (if that makes a difference). The sales price was $455,000 and there is a $91,000 gift of equity. What I need to know is do I reduce the sales price by $91,000 to $364,000 to minimize the capital gain? Their cost in the house is $403,390 and they would have a $51,160 gain if I use $455,000 as sales price causing them to owe $6000 -/+ in taxes. If I reduce the sales price by the $91,000 or deduct it as a selling expense they will receive a small refund. I have researched this and I am finding conflicting answers to my question even from the IRS.

I don't remember having this problem too often, except when I go to DOS and run the batch file to delete all the files in my cache and temp directories (which I know deletes the cookie files). But I had to log in last night after I clicked "Save" to save a message with about two paragraphs that I had typed (in the silly American Idol message I wrote last night). The message was not saved, had to log back in, and retype it all. It hasn't been a problem for a long time until that one time late last night. Deback 14:50, 17 February 2007 (CST)

I might have found a bug within the Proseries Illinois Software JR1 (Jeff),

I trust your tax season is going well. Just to refresh your memory, I have written you a few time regarding tax matters. My name is Chet (screen name Truthseeker). I also live in Cary Illinois. I am writing you because I have encountered an error within the Proseries Illinois software and can't seem to get any help from Intuit's tech support. Here's the issues, see if you can recreate:

Problem: The TP received unemployment compensation in 2006. She received an Illinois 1099G. TP, also had federal and state withholding deducted from payments. Using the Proseries 1099G worksheet, I entered the unemployment compensation amount on line 1. Afterward, I entered federal and state withholding on lines 4(a)(b). Everything in federal checked out fine. Performed a final check in the state, no errors. However, when I performed an Efile state final check, the program flags the file with an error(w2; w2G not allowed by state).

WorkAround Solution: I removed the 1099G state withholdings and move the amount to an estimated payment worksheet. This seem to work for the state's final efile check. However, I've encounter another problem. The state of Illinois Department of Revenue sent a letter to the TP informing then of a error on their 2006 tax return. They told the TP that they made a correction on their return, and the client would be getting an additional $60. Very strange assessment by the state, the numbers don't gel. Based on my manual computation no way the TP should be getting additional funds.

JR1- Don't mean to bug you, just wanted to know if you are having the same software problem for the state of Illinois. Write back if you can help.

ps: If you are able to re-create or are having the same problem, do you think I could get Tim Doyle to help contact someone within Intuit Proseries organization?

Depreciation Tables

Tim, it would be great if we had the depreciation tables handy and easy to find (MACRS table telling us what percentage to deduct for years 1-5 on 5 year property, 1-7 on 7 year property, etc.) Maybe it's here, I just cant find it easy. Formatting posts

Tim, why is it that spaces are not recognized? For example, if you look at my GET example on the e-file requests post, you'll notice I used lines to separate the various items I was trying to show. Initially I had two columns, but all of the numbers just ran into each other in a line rather than being separated by the spaces I had input. Using lines was the only way I could keep the items separate so people could easily follow what I was trying to show.

Depreciation Tables

could be called that - Depreciation Tables, a quick link that would take you to the appropriate place on the IRS site would be fine - we need one for each class life for MACRS (half year convention)(3, 5, 7, etc years), possibly for ACRS (although everything ACRS is fully depreciated by now), and possibly for Mid Quarter Convention for MACRS for each quarter.

No need to re-type them here - just need a fast way of getting to them.

They are helpful when you have to reconstruct a clients depreciation taken. Who can remember what the first 3 years % are for a 7 year MACRS asset? I might remember year 1 and 2, but not any more than that.

Tim, I contacted JR1 and he informed me that Illinois put out a directive instructing preparer that we couldn't efile the state with-holding amount for unemployment compensation. User suggestion

how about putting the user codes/credentials next to their name on the posts...that way we know right away the experience of the user. Perhaps a checklist on the registration page where selections of expertise, pro preparer, self preparer, non paid preparer or such; coded next to name as PP, SP, NPP, EA, CPA. There is so much resource info out there for anyone to research and I don't mind sharing my experience and knowledge but we get so busy this time of year it would be nice to be able to weed in/out the 24-7 lazy from those that we could be spending our time with. taxea

Templates

The discussion templates seem to strip curly brackets, substitute coding such as "& #125;" for }, and prevent using other templates. I presume this is somewhat by design. Is there any work-around other than editing the page afterward?

Your explanation is as I suspected. I was hoping there was a simple escape character, such as a forward slash before the curly brace, that could allow the call to the template. The quicklinks are good, but I have already spent more time on trying to figure this out than I have to spare. 1099 misc nonemployee compensation

Hello, I have read some of your responses for this question and I am confused on something. I received a set of golf clubs from a company and they sent me a 1099 misc form. The amount is in box #7 nonemployee compensation for $640. I guess it would be considered a "Spiff" and you said to put on line 21. The confusing part is that in the instruction book for 2006, on page 29, it has a big blue caution warning that says "do not report on line 21 any nonemployee compensation shown on Form 1099-MISC. Instead, see the chart on page 15 to find out where to report that income." The chart shows that I need to fill out a Schedule C form but I am not self-employed or an employee of the company that sent the clubs. I am so confused, what do I do?

Like the new sort function, however, how do i make it sort all posts with no replies to the top. When i click on the replies button it gives posts with most replies. When i click again, not sure what i'm getting, but definately not the ones with 0 replies.

Here’s a layout of the business/legal/accounting issue I’m trying to understand.

Some background: I'm a chemist and I've been doing contract research and consulting on the side for about ten years. Two years ago I left a full time chemistry position to do this full time. I have been operating in that capacity as a Sole Proprietor. A year and a half ago a friend decided he would like to do the same thing. We signed a lease together and share 20% of the space. Of the remaining 80%, half is mine and half is his. We have not yet formed any sort of partnership, but we are looking into forming a company that does contract research and consulting. I would like the liability protection afforded to a LLC or S-corp. We do not plan to work together on many projects, and in many regards we should be two separate companies. On occasion we may pass along (subcontract) certain aspects of projects to each other. The main reason we would like to do this together is that we would like to market ourselves together to the outside world. We also feel that the whole will be greater than the sum of the two parts, so we would like to have a joint website that mentions both of us and features our expertise and capabilities. The other reason to do this together is to reduce redundancy (business license with the city, LLC with the state, liability insurance, environmental health with the county...). We have agreed to basically keep our finances separate other than a few shared things like the rent and utilities that we have agreed to split.

Single Business (LLC) Model: We were advised to form an LLC where we are partners and thus file 1065/K-1's. Under this model, we would have the liability protection and we could change the partner's share of profit, loss, and capital to reflect the partner's activity during the year. I am comfortable with this for times when we both earn or loose money. I am however uncomfortable with how to fairly and legally do this when one of us is positive and the other is negative. I have a high expectation that this will not work forever, and that one of us will eventually get a full time job, but fulfill our commitment to 50% of the lease payments for the next three years. If we were separate businesses, then the losses could be taken against other earnings or carried over to the next year. Under this model, the only way to do that is for one K-1 to be positive, and the other to be negative. I called the IRS, and that is not okay with them. Another would be to have one positive and the other zero. That's great for the positive partner (reduced taxes), but unfair to the other. I presume a behind the scenes gift to the other partner to make up the difference is not legal. I don't know if a behind the scenes carryover to the next year is legal. If one partner is continually making capital contributions instead of sales to pay their portion of the rent and utilities, is there a way to reflect that in the 1065/K-1 to make it all work? Would that make the positive partner unaffected? And once the negative partner had earnings could they be taken against the high capital expenditure? Or when one of us sells/leaves will we have a long term capital gains loss to make us whole...

Dual Business Model: Would some sort of co-marketing approach where we each set up our own LLC's, so A LLC and B LLC work. If so, can we market ourselves under another name (C)? How? Can we each file a fictitious name statement for the same name (A DBA C and B DBA C)? We do live in different counties, so I think that might be possible. And does that void any liability protection? I was given the distinct impression that sharing a space, splitting the rent, working in the same field and using the same business name (even if under a DBA) implies a partnership. Or if one of us uses "C" as the LLC name, and the other is a subcontractor (with their own LLC), can the second person have their name/capabilities listed on the "C" website etc.? Or would this too void certain liability protections afforded to the LLC structure.

Am I missing another approach?

goodwill amortization / separately officer compensation

I may not be following protocol but 2 things I need clarification on, hopefully easy Qs for you:

1) bought a snack distr route 3/06 for 93500; declared as an s-corp for 06; legal fees re to purchase 600; if I assign total cost to goodwill and elect to amortize over 15 years, I'll take 4705 off this year's income. Do I line item that 4705 as an other deduction? if not, where do I claim the amortization?

2) back in Nov 06 I sent eftps $150 figuring (wrongly now I think) I would be setting aside tax obligations for my own (the Officer/Shareholder)'s compensation. so now I think I've overpaid $150 S Corp tax and not set anything aside for my compensation withold...Do I just get the 150 refunded when I electronically file the 1120 s and let my proseries basic set aside my tax obligation for the $1200 I have declared as Officer/Shareholder compensation?

Thanks, Tim. We had pictures taken in January (with my son, daughter-in-law, and grandson), and he just brought them over yesterday for me to scan them all. The hairdo has to go, though. Thanks for your reply to my questions. Just to let you know, I did contact a couple of users via their talk page and they were kind enough to reply. It's taken me a couple of years to get brave enough to post on this site, but I really enjoy the discourse. I find myself getting more involved in questions where I am a third party bystander than I ever thought I would be.

I'm hoping there will still be plenty of participation after the tax season rush, when there might be time for more in-depth discussions.

Does ProSeries 2007 require SP2?

I don't know if you can help me with this or not. The system recommendations (stand alone) are unclear and tech support gave rote answers. I am running XP Professional with SP1 because upgrading to SP2 would have required me to flash my BIOS.

Question on Processing Returns

I am trying to get a new "system" for processing my returns. I did about 1,300 tax returns during this tax season, (I use Proseries).

After I have completed and printed out the returns, my office staff takes over. They review the returns, Efile the returns, get the authorizations signed, etc. Currently, we use an excell spreadsheet, to track the returns through the various stages. Is there a better alternative? I was thinking of using Access or a DB program. What about "Practice Manager"? Your thoughts would be appreciated.

Thanks for your help!!! I have a suggestion. Is it possible to get a "go to top" button on the pages? Also, is it possible to put a "back to tax questions" after you have asked a question or even after researching a tax question. I guess the "back to...." would have to be filled in for each of the types of forums that you have. Maybe that is a lot of work. All I know is that it would make searching when one is in a hurry. Just a thought or rather two thoughts.

user tester

Tim,

I like your new page. It builds a nicer feeling of community like my space and another new one I can't think of. I would scrimmage it with some of our key users for feedback.

Not sure if this is related, but Steve Blundell does a nice presentation on how accountants can better build their practices (net promoter, demographic channels, etc.). I wonder if there are any opportunities to incorporate this information into TaxAlmanac somehow. If interested we could a hold of the presentation.

Tax on booth rental

I am not sure how I got here but I have a question and hopefully you can answer it. First of all I am a Salon owner and rent out booths. I have been incurring the taxes for the renters on their ren and need to turn it over to them to pay it. I need to justify that what I am doing is correct. It would be helpful to know how they should pay it. If they include it in their rent check? Or is it a seperate check? If they pay it when doing their quarterly taxes? What percentage is charged and or do they pay it to me or on their own to whom when and how much?

Of course I have rent also on the space that I pay tax on. So I am paying rent tax collecting rent and paying their rent tax. Can you clarify it for me please and to my email addy incase I can't get back to find your answer on this site.

How to do Tax Research

I would be willing to help write an article if I could also have the ability to have the article submitted for publication (NATP Tax Journal or NAEA EA Journal etc). The published article could, of course, mention Tax Almanac as a resource - which would be good publicity.

I believe that a lot of the members of both NATP and NAEA could benefit from such an article. I can't speak for the CPAs using the board (well I could, but I have no authority other than plain observation). Kevinh5

Published Article writing

Yes, the 2/3 route would be the best way to go.

The "publishing/ed author" writes an article for submission and publication to an industry journal. The author must be whoever the author actually is, so all collaborators would have to get credit or one author must do it all.

Then that article could be amended/revised and posted on TA where other collaborators would be free to change and update.

As far as copyright, as long as the published author knowingly contributes the info to the wiki then there wouldn't be any problems. I have submitted technical articles before to journals and they wanted me to sign off that they would have "exclusive" use of the text. Obviously you can't grant exclusive use of the ideas if you are submitting them elsewhere, but you could grant exclusive use of THAT PARTICULAR text.

So the submission to TA couldn't be, word-for-word, the same as what was submitted for industry publication. Kevinh5

Attitude on the Responses

Tim: I am disturbed by the tone of some of the comments to questions asked. We don't all have the same level of experience and I work hard to give my clients the best tax advice possible. Being an independent CPA and a one-person office, it helps to have someone to bounce questions off of, even if they do seem stupid to some. If I continue to receive the same level of sarcasm, I will have to seek advice elsewhere. We don't all think in the same terms, so it makes it difficult to search and use the same terms as someone else. If I put in "depreciation" on a topic to research, I would think all discussions would be brought to light. However, it seems, I must have missed putting in the right combination of words.

Seriously, I thought people were involved here to help one another, not to pull oneupmanship. Thanks, Shirley

Just trying to formulate my thoughts. I've spent some time wandering around the site. Everything seems to be there, just harder to find with all the additions. Seems to me if we want community generated articles to be easily referenced we need a separate sub-category with its own index. With so many articles labeled announcement or notice, etc. you can't really page though and browse any more.

Trying to confirm e-mail address

Hi Tim,

I'm trying to confirm my e-mail address in my profile so that someone could contact me directly through my user profile. I've clicked on the Confirm E-mail Address (or something similar) button but did not receive a confirmation e-mail. I noticed that I wasn't receiving any e-mail updates of my bookmarked pages. I also don't recall having received an original confirmation e-mail when I setup my username with an e-mail address.

I guess while I'm writing I'm wondering if you could combine some old usernames that I had experimented with before settling on this one. I had setup both "allanlazo" and "ortaxman" before consistently using "OR_Taxman." Can these be combined? If so, the previous ones -- "allanlazo" and "ortaxman" could then be deleted.

Changes to the site

Tim, wondering what changes to the site are you planning or have you made already and I'm missing something. I have been very disappointed with the direction the board has taken for quite a while now. I by no means have a ton of experience nor do I probably contribute the best replies, but I do try and when I know something or at least believe I know, then I will answer a question here or there. I also have often used the site to ask questions and in the past at least, have learned a great deal from the give and take that goes on when someone asks a question or if I ask the question. It appears to me based on various posters that I am not alone in my disappointment. Because of what appears to be a few, there are now going to be changes? Perhaps there are some things I am not aware of and if I am out of line, I apologize. Used to be we could just ask a question and either someone would answer or not. Now we have some like KevinH who are more interested in someone's profile than just answering a question and helping someone out. I just don't understand what the big deal is. If you don't want to answer a question, for whatever reason, then just move on to the next post. I hope I have made some sense here about what I'm trying to say. Yeas, Nays and Touch Voting

Hi Tim. When you take the Yeas and Nays, the loudest voices seem to carry more weight, as you know. I have myself been silly and rude to some of the non-pros., on the other hand, I don't consider myself a tax genius to begin with. The problem I have with "professionals only" is that some regulars are here to essentially market to the rest of us (they teach classes etc.). As long as they disclose this in their profile, this does not bother me in the least; nevertheless, it has to color their views, if you know what I mean. The only thing I can add is what I said to Sandy, which is to somehow put a restriction on during tax season. If you took a real vote, I think a full-time ban would lose (that is only a guess). And of course, I'm sure it's not a piece of cake to implement. Dennis and Riley, two of the best, have been very willing to help the non-pros (despite a recent dust-up w/ mistaken identity), and D&T and JR1 (whom I consider some of the best and the real souls of the board) seem to have no problem with it (most of the time). I can't speak for them, obviously. I think the highlighted notice you have now at the post screen gives the non-professionals a fair warning: proceed at your own risk.

Changing email address

Tim, was trying to change my email address. It gave me a message that it was sending a confirmation email, but it never arrived. I tried this a few times and it still never arrived. I changed my email back to what it was and again, it said it was sending a confirmation email. It arrived in seconds. The email address I was trying to change to was an @comcast.net address. It is currently a @Yahoo.com address. Are you having any problems with comcast addresses? It's not a big deal, as I do use both email addresses, but would prefer to use the comcast address.
