buy-out/sale of clients in multi-level marketing program

I'm new here and would like to know if anyone has insight to the character of the asset of a buy-out/sale of clients in multi-level marketing program, where the organization buys out (or purchases) the retiring individual cashflow generatedat a set formula?

Is this capital gain or ordinary income?

thanks inadvance!

Thanks for being willing to share your knowledge with others by responding to questions on TaxAlmanac's discussion forums for tax pros. We like to feel like a community here, so I hope you’ll add a little info to your user page / profile to give some info about your background/level of experience, and (quite secondary) maybe even some of the other info as shown in the boilerplate language. Other users can then click on your name in any discussion for a quick way to get to know you a little, and the information you provide might also help them to assess the reliability of your responses (I think that might be what Lalva was trying to say on the recent discussion about the Mexican Fideicomiso).

Here are some great resources for getting to know TaxAlmanac if you’re new to the site or haven't been using the site recently: Policies, Code of Conduct, FAQ, an Overview of TaxAlmanac, and Hints and Tips on How to Search on TaxAlmanac.
