HSA

The HSA can be used for all medical including over the counter drugs that aren't allowed as itemized deductions. I can't remember (off the top of my head) where to find that but I know that for a fact. I'll see if I can find it later when I have some time, but anyway it doesn't matter if your insurance doesn't cover it, with the HSA you can deduct anything from bandaids to contact lense cleaner. I'll try to find it later & send it to you.

response to email of hawaii question

Hawaii tax

Hi Joan I see Nat answered your question. She is right...Hawaii, unlike CA does not let you deduct TDI taxea

Aloha and Mahalo for your help

Thanks, Joan, for your comments about the Brother printer. It seems very simple, I didn't get a chance to work with it yesterday. I was finishing a really complicated return, then just as I was getting ready to print it out, realized that in 2008, the previous preparer hadn't taken the deduction for S-Corp medical and had to call the client. Now I have an amendment to prepare as well. Anyway, I'll give it a shot, I must have the software you mentioned because I have seen the screens you mention, just didn't know the right way to configure it. I hope you find the engagement letter/questionnaire useful. Since you are in Texas, I have a multi-state tax question, if you wouldn't mind pointing me in the right direction.

Client works as a subcontractor (sole proprietor) for a company (SMLLC/ sole proprietor) that sends him to various stares to work for periods at a time, usually 1-3 weeks. He was in Texas in January, so this is for 2011. (in 2010 he was in NY, CA & WI, so if you know anything about those states & localities that would be helpful too)

I haven't looked up the TX requirements yet but I am assuming that he must apportion his income to TX for the period of time he worked there. I also assume that I can get most of what I need from the TX website. What I am not sure of is local taxes or any filing that might be required to worki in TX because he is a sole proprietor. He was in Grand Prairie, if that is important. If you could give me the basics, particularly if there is some registration required (that of course he didn't do!), it would be helpful. Thanks!

Thanks! I hadn't started looking at Texas. Good to know I he doesn't need to wory about it for 2011. He's not so lucky with 2010 though! I will edit the other letter today.

CyberAssistant

Hi, Joan - your cyberAssistent question had been on the tax forum, and had one response, but it's now fallen to page 2 of the index, so I've relocated it into the Practice Mgt/Business Growth forum, which is more the right place for it (it's software-like, and certainly part of managing a practice, much more so than it's a technical tax question).

You can still get to it via the "my contributions" link at the top right corner of your screen, or here: Discussion:This just in...hot exclusive..Cyber-Assistant delayed....

Hawaii question

Aloha Joan, I'm not sure what your question is. If the N848 is a POA, and it was filed in 2009, I would expect it to stil be valid. If there is a concern about it you should have them sign another one. Are you talking about personal taxes owed? I would write a letter to the Department of Taxation in Honolulu to find out what is owed and provide a copy of the POA. You can get the address from the website at hawaii.gov. Calling will only result in either a long hold or needing to have someone return your call. Do your clients have any mail from the DOT? That should be an indication of what is owed, as well as provide phone numbers and address for communicating. Paula Actionbsns 18:25, 18 June 2011 (UTC)

Dependent Care FSA Question

Thank you for your help in the Dependent Care FSA question I posted earlier today. Your analogy makes sense, and after reading the forms and doing some research (as well as reading the post responses), the answer is quite clear.

My head just wouldn't let go of the ability of a TP to use a medical FSA and itemize excess expenses. It was just the term FSA, I suppose.

Thanks again for the help!

He's got two threads going

Joan, I thought I'd let you know that Kirkland has two threads going, and he's already wiped out all the previous responses that were given to him by our members here. So be forewarned. He has a thread on the tax page, and one in the chat room that you posted to. I just wanted you to have some history just in case you didn't already know what had happened.
