Can a high school student paying tuition to qualifying community college through the high school qualify for LLC? It is a "Govenor's School" the the school system.

Is the high school student filing a tax return or are they a dependent on their parents return?
Will he/she be earning a degree at this "Govenor's School"?

The credit will be for the parents and the credits apply toward associates/bach degree at comm college

My daughter took advantage of the dual enrollment program while in high school but did not have to pay tuition to the community college. That is one of the biggest advantages of the program. Are you sure your client is having to pay the tuition? I remember having to pay for her books but did not deduct them as a Hope or Lifetime credit.

Then there would be no credit due if no tuition paid -- but my client did in fact pay tuition fees

Well then, if tuition fees are in fact paid then they qualify for the credit. I still don't understand why they are required to pay tuition if it's part of a qualified state dual enrollment program. Perhaps someone else has an opinion.

Keep in mind that, if you take the 1st year Hope Credit while the student is in high school, the taxpayer will have only one more Hope Credit left. How much tuition was paid in 2006? Is it a material amount? Will the student be paying a lot more for tuition after he graduates?

The Lifetime Learning Credit is for post-secondary education, for non-degree courses, and graduate-level degree work. I figure the LLC for any tuition paid, except for the first two years of pursuing a degree at a post-secondary institution. Community colleges qualify as eligible educational institutions. So, yes, if the student is enrolled for at least one academic period.
