If you can still get something for the shares, it's not worthless. Have your client tell her broker to sell it for $1, then she can take the loss.

My client checked with the broker and was told to wait and deduct for 2009. 2008 still had some value and can't deduct partial loss.

Wasn't WaMu taken over by Chase? Was the stock exchanged? I'd check out the investment with Chase before it's written off as worthless.
