I am a sole prop. currently but may soon be going LLC. I am registered with the IRS as an e-filer. According to the e-filer rules, when changing legal entity type one must do a complete re-filing of the application to e-file; this includes getting fingerprints again and long long drawn-out online app. All that is changing is an LLC after my name. Is there anyway around this? Has anyone gone through this before

Don't think so, you're still filing Schedule C right? I don't think so is my kneejerk reaction, Scholars????

Yep, I would still be (for tax reasons) Schedule C, but legally I would be LLC. According to the official rules pertaining to e-file originators (from the IRS site), an entity change requires a re-file to become an originator. If there is some way around I would love to go for it since its a hassle to do it again (plus fingerprinting).

well, layman's terms, I've moved 3 times and became an LP and I reckon I was supposed to get a new efile number each time but I like my number so much I'm just keeping it, I figure it's better to ask forgiveness than permission, I'd never get a number like I have ever again, I have a personal EIN that is connected to the EFIN and until I get a nastygram from the IRS, I don't want to raise issues on my own.

Donnie, I agree completely with the forgiveness line. But are you just being funny about the number or is there some major similarity between the two? Just curious.

I can actually remember my EFIN is all, it's like a 112233 and I'd just as soon keep it than volunatarily throw it out and end up with a number like 39845 or something, I'd have to change so much crap and deal with so much paperwork if I changed it.

According to the "rules" you only need to make the complete re-submission if your entity changes, apparently address changes can be made in the existing file.

Donnie, at this point I am seeing your point and I agree, especially since the name of the business is only changing by adding an "LLC" to the end. I don't see the point of having to go through the hassle.

Maybe the IRS messed-up, but I've got two EFIN's, one in my name, one in an LLC's name, and I only filed once. Besides that, I went from a SSN to an EIN, and still kept the current EFIN. Maybe I live in the IRS Twilight Zone....  ;-)

For tax purposes an LLC is still a sole prop. so I'd say no need to change the number, but that's just my totally unresearched thought.

True enough Kathyt, but based on their directions/rules governing the e-filer they do not delineate between the legal entity and your filing classification. Based on what others have stated, the IRS is not monitoring these. I just can't see doing the whole thing over again just to add LLC at the end of my business name. You are right though, in my case I am still going to be a sole prop. Now I could see their point if I was changing my filing classification (i.e. from sole prop to partnership).

The way I read Pub 3112 is that you only need to reapply to the e-file program if the structure of the business is changed in a way that [b]requires[/b] a new TIN. Based on that, I would say that a sole prop going to a smLLC wouldn't need to reapply.
