I have a client trying to establish an LLC in the State of TX. Is it possible to have a name for the LLC (say, ABC LLC), but operate under a different name such as XYZ Consulting? How does this work on the 1065 tax return or does the diff. name even need to be reported to the IRS on the 1065?

Could there be any legal issues from a limited liability standpoint - for instance the limited liability protection exists for ABC LLC, but not for XYZ Consulting?

Also, does the other name have to be registered with any governmental agency (Local, State, or Fed). Thanks.

Don't know if TX does Fictitious Names. I'd try looking at the TX government website for corporations and look up Fictitious Name.

You will register a DBA if the LLC is operating under a name that is different than the name that is organized in the State. In other words, the LLC is the legal entity...DBA XYZ consulting is the "name" statement to do business that needs to be registered with the state...
