Wife and I are seperated. We file married jointly. Put her new address on tax returns and never seen the federal check. said she needed the money and cashed it.I never signed it. can anything be done aabout this?

| It sounds like she probably endorsed and cashed the check. If that is the case, it is forgery. Depending on how much money that you are talking about you might want to press charges & find some means to recover funds. | |

| Most banks would accept the check to her separate account with no endorsement or just her signature on the back. This would not then be forgery. Banks are not real careful about this stuff, with the millions of checks coming through their accounts.
Talk to a attorney about what can be done. | |

| I would think the bank would have some responsibility in this if they accepted one signature on the deposit. Either way the wife is responsible for forgery if she, in fact, signed for you. Make a police report and have them contact her. Also if the amount was over 400. it is a felony. If you make the police report be sure you are willing to follow-through with the complaint, don't waste the department's time. | |

| Also, depends on HOW the check was made out...if it is made out to: Mr. OR Mrs. Jones, then either party can cash or deposit it without the other. If it is made out to: Mr AND Mrs jones, then both signatures are required. I would check with my bank..if they cashed it without the correct information, then they can be held liable for your portion of the refund... | |

| We know how the check is made out because he stated it was a joint return. Check was definitely Mr. AND Mrs. so bank is clearly at fault. I also strongly disagree that banks would accept the check with just her signature. On Federal checks, banks are VERY, VERY careful to avoid this exact situation. They know exactly what the rules are. | |
