| My client has a letter from IRS stating that his W-2's and W-3 for 2006 seem to have not been filed. I have copies of the W-2's, but there is a note that I was unable to find a W-3 when I prepared the tax returns for 2006. The form at IRS.gov clearly states not to use it, my 2006 payroll program doesn't appear to be active on this computer so I can't print one. Does anyone have a blank one they can send me or FAX to me? The other option is to just run the risk of the $50 penalty or throw ourselves on their mercy and just the one that is forbidden. | |

| The W-3's on the IRS website are informational only and there's a caveat attached to them warning against their use and assessing a penalty of $50 if you do use them because they aren't scannable. It really needs to be taken care of quickly since the letter was dated back in June and the client had it stuffed in with a bunch of other letters he was getting from IRS at the time. If there's not one available quickly, I think I'll copy it in black ink so I can get the letter taken care of. It actually goes to IRS not the SSA. | |

| You asked for one to be faxed and print quality from the web PDF would be the same, so I assumed you were more interested in speed that anything else. | |

| The caveat on the 2006 Form W-3 that's on the IRS's website states that you shouldn't download and file the form with the SSA because it could result in a $50 penalty for filing a form that isn't scannable. Since you are going to file the form with the IRS (not the SSA), does this rule even apply? For a 2006 Form W-3, the client is probably going to be hit with a $50 late filing penalty anyway. | |

Dave and Kathi, that's pretty much where I'm going with this, since it's not being filed with SSA, that rule is most likely a moot point, but if I can avoid an issue with a form they don't like, it would be better. If I don't have one by end of day, I'll just copy this red one from the website so it's black and complete my response before they get any more cranky than they already are. Thanks for the help. | |
