I was wondering and have heard two ideas on this. Transportation Limousine does the operator charge the client sales tax. (Wisconsin) Some Limousine companies say yes charge and others say no as a service company you do not have to charge sales tax and years ago when I worked for a Limo company they charged the sales tax but I never saw them make any payment to the state for the tax. So What do I do do I charge sales tax and if so what. (Milwaukee,Wisconsin)

Skhyatt is correct. Sales tax rules vary from state to state, with some taxing services and others not. Look up your state tax department on the internet, or give them a call on Monday. A local accountant can also help and make sure you are properly registered with the appropriate taxing authorites.

In California, it appears that a limo service would not be subject to sales tax, but the rules could be different for your state.

Rt3020, although I do not live in Wisconsin, I checked with my CCH Wisconsin reporter and found that sales tax applies to leases of non-chauffeured limo's, but not to the hiring of chauffeured limo's since this is a service. See Wisconsin Statutes Sec. 77.995 and Wisconsin Private Letter Ruling W9238011.

I have read about the Statues Sec. 77.995 but can not find the Private Letter Rulling W9238011 and my main question is that my company is running only sedans and does not fall under that 5seats behind the driver as sates in the statues. I have already sent a email to the WI DOR but would like to find this private letter ruling to read up on.
