| I know we have to give clients a copy of all tax forms we prepare for them. When client e-files and they sign 8879 do we need to give client a copy of SIGNED 8879 or just a copy of 8879? If client is not sitting in front of you to sign it delays putting together thier copy of tax folder. | |

| IRS publ 04176 (5-2003) says to keep a copy and give the client a copy. I always keep the original. I have in the past received a request from the IRS for copies of all form 8879 on file for a particular year. | |

| Thanks for the info, I guess I won't even start putting thier folder together until I have all signed docs in hand. | |

| TLF, why not print two copies of the 8879. Affix your signature to both. You can compile one copy into the clients copy. Their copy would only be missing their signatures. Then have them sign the loose copy for your records.
It's a drag having to assemble returns while the client is watching. Personally, I keep the 8879 loose. The client signs it, I copy it, and tuck it into the folder. | |

| The instructions for form 8879 say:
"Provide the taxpayer with a copy of the signed Form 8879 for his or her records upon request." | |

| So if I want to just give them an unsigned copy for their tax folder and keep origional for myself, I'm o.k. Taxpayer will probably never request a signed copy of 8879 anyway. | |

| When you think about it the signed form is the "original" which is kept by the preparer. Any other is a "copy" and does not require signatures. I have never had a client as me to sign their copy. Nor do I sign their copy of the efiled tax return. Occasionally I have to educate the mortgage company or the dependent's college finance office but I don't sign copies. taxea | |

| Kevin I'm glad it is you. This is one of those husband and former wife issues. The 8879 from 06 both fed and ftb mysteriously disappeared from the file, wife claims she never signed. Strangely all the other 8879's are there. I did see it otherwise I would not have filed, where it went is a mystery to me. File goes with me to clients office every year. | |
