Here you go, Kevin, I'm there and I take every Sunday off. I'm asking this and I don't care how dumb it is. Sales rep paid as an employee gets a flat $300 every two weeks for auto reimbursement. Non-accountable plan and 100% included in Box 1 of W-2, nothing in Box 12. TP keeps mileage log and has over $10,000 using SMR. HR tells him that he reports W-2 income as is and can only deduct difference between reimbursement and SMR on 2106. This is wrong, isn't it? All of mileage goes on 2106, right? Non-accountable and all reimbursement included in W-2. Thanks.

If it is included in box 1 then you can deduct all the mileage without reducing it by the reimbursement. You are correct.
